Petitioner seeks bail in a case registered for the offences punishable under Sections 363 and 366A/34 of the Indian Penal Code.

The FIR was lodged on missing of Sonam Kumari, aged about 17 years. On recovery, the victim-girl alleged kidnapping and rape by the petitioner.

Submission of the petitioner is that the matter is of love-affairs which would be evident from the love letters written by the victim at Annexure-2. However, subsequent to the marriage vide marriage certificate at Annexure-3 under pressure of the parents, the victim resiled from her stand and gave statement under Section 164 Cr.P.C.

No.15893 of 2017 (3) dt.15-05-2017 2/2 Considering the aforesaid fact, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur/successor Court in connection with Bochaha Police Station Case No. 137 of 2016, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
