This is an application for regular bail on behalf of the petitioner for the offences alleged under Sections 147, 148, 149, 109, 341, 323, 307, 504, 506 and 302 of the Indian Penal Code and Section 27 of the Arms Act, registered in connection with Udwantnagar (Gajrajganj) P.S.Case No. 128 of 2022/S.T.No. 216 of 2024.
3. The bail petition of the petitioner has twice been rejected by this Court. While rejecting at second time, vide order dated 12.07.2024 in Cr.Misc. No. 11033 of 2024, it was observed that the trial court shall take every endeavour to dispose of the trial within one year. It was further observed that if the trial is not concluded within the stipulated period, the petitioner, if so advised, may renew his prayer for bail.
4. The learned counsel for the petitioner has submitted that the petitioner has remained in custody for more than three years, but still the trial has not been concluded,
Patna High Court CR. MISC. No.53692 of 2025(3) dt.12-09-2025 2/2 despite specific observation of this Court, vide order dated 12.07.2024. He has also submitted that, according to the report of the learned trial court, half of the charge-sheeted witnesses are yet to be examined.

Considering the above facts and circumstances of the case, the period of custody and the snail's pace of the trial, let the petitioner, above-named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District Judge-X, Bhojpur at Ara in connection with Udwantnagar (Gajrajganj) P.S.Case No. 128 of 2022/S.T.No. 216 of 2024, subject to the conditions that the petitioner shall cooperate in the disposal of trial and make himself available on each and every date fixed at the trial, and if he fails to appear on two consecutive dates, unless he is prevented by extremely adverse circumstances, the court below shall be at liberty to cancel his bail bond.
