2. The petitioner apprehends his arrest in a case registered for the offence under Sections 272, 273, 420, 120-B, 34 of the Indian Penal Code and Sections 30(a), 32(2), 32(3), 36, 41(1), 42(2) of Bihar Prohibition and Excise Act. 3.151 liters of illicit liquor has been recovered from the ambulance.

4. It is submitted on behalf of petitioner that petitioner is neither owner nor driver of the said vehicle and has got no concern with the seized liquor.

5. However, learned A.P.P. for the State vehemently opposed the prayer for anticipatory bail and submitted that petitioner is named in the F.I.R. and has got two criminal antecedent of similar nature.

6. Considering the fact that petitioner has got criminal
