JUSTICE JYOTI SARAN ORAL ORDER 17-12-2015 Heard Ms. Soni Shrivastava, learned counsel appearing on behalf of the petitioner, Mr. Anand Mohan, learned Additional Public Prosecutor for the State and Dr. Ajeet Kumar, learned counsel appearing for the complainant. The petitioner apprehends his arrest in connection with Complaint Case No.29447 of 2014 registered for the offences punishable under sections 200, 418, 420, 468, 120B and 511 of the Indian Penal Code.

Ms. Shrivastava, learned counsel appearing on behalf of the petitioner with reference to the petition of complaint placed at Annexure-1 submits that although the entire allegations revolve around accused no.1 who happens to be the son of the petitioner but it is only account of the relationship that he has been arraigned as an accused. She submit that the entire

No.52976 of 2015 (2) dt.17-12-2015 allegation revolves around 15 decimals of land bearing plot no.1673 which as per the complaint itself has been sold by the accused no.1 claiming to be his own purchase and it is this portion of the transaction which has led to the complaint case. The complainant has registered her appearance through counsel who submits that the father and son both are involved in such transaction.

Having heard learned counsel for the parties and considering the nature of accusation as reflected from paragraphs 2 and 10 of the complaint petition which revolves around accused no.1 who happens to be the son of the petitioner, let the petitioner, namely, Ramji Prasad Singh in the event of his arrest or surrender within four weeks from today be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Kumari Jyotsana, Judicial Magistrate 1st Class, Patna and/or the court concerned in connection with Complaint Case No.29447 of 2014 subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
