Learned counsel for the petitioner submits that the cognizance order dated 17.09.2013, passed in Complaint Case No.1221 of 2013 by the learned Judicial Magistrate, 1st Class, Gaya was also challenged in another Cr. Misc. No.11321 of 2014 by another co-accused Ravindra Kumar Singh, husband of the petitioner of the present case, and the same was already disposed of by order dated 07.11.2017 by a coordinate Bench of this Court whereby the entire cognizance order has been set aside holding therein that considering the facts of the case, it appears a case of civil nature so the present application has become infructuous now.
