The petitioner is languishing in custody since 18.05.2019 in a case for the offence registered under Section 414 of the IPC.
The prosecution story, in brief, is that on 18.05.2019 the informant who is A.S.I. of Maniyar P.S. alongwith SAP forces were checking the vehicle. In the mean time, one young boy riding on a Motorcycle without number was coming when the police stopped him then he tried to flee away but he was caught hold by the police and on being asked, he disclosed his name as Satyendra Roy (petitioner) and on demand, he could not produce any document of the said Motorcycle. Patna High Court CR. MISC. No.51556 of 2019(2) dt.20-08-2019 2/2 petitioner that the petitioner has falsely been implicated in the present case. Charge sheet has been submitted in the present case. There is no allegation of tampering with the witnesses alleged against the petitioner. The petitioner had no knowledge that the Motorcycle in question is a stolen property. He has been made accused in the present case due to mistake of fact. On behalf of the learned counsel for the State, it has been submitted that the petitioner is named in the F.I.R. Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned J.M. Ist Class, Muzaffarpur, in connection with Maniyari P.S. Case No. 116 of 2019, G.R. No. 1572 of 2019.
