In this case, the petitioner is seeking anticipatory bail in connection with Samastipur Town P.S. Case No.237 of 2017, registered for the offence punishable under Sections 420 and 406 of the Indian Penal Code.
Allegation has been made that the petitioner has taken loan from the Bank and mortgaged the property as security, but his account was declared as N.P.A. Present criminal case has been lodged against the petitioner, making allegation of cheating and misappropriation.
Primarily, it is a civil dispute, which has been given the colour of criminal case.

No.5824 of 2018 (2) dt.01-02-2018 2/2 Looking to the aforesaid fact, let the petitioner, namely, Manoj Kumar Roy, be released on anticipatory bail in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Samastipur, in connection with Samastipur Town P.S. Case No.237 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
