2. Petitioner apprehends his arrest in a case registered for the offence punishable under sections 137(2), 140(3) and 3(5) of the BNS.
3. As per the F.I.R., the allegation against the petitioner is that he has kidnapped the daughter of the informant.
4. It is submitted on behalf of the petitioners that petitioner is innocent and has committed no offence as alleged. The statement of the victim was recorded under Section 183 of the Bharatiya Nagarik Suraksha Sanhita (B.N.S.S.), wherein she has denied the allegation of kidnapping and has further stated that she has voluntarily solemnized her marriage with the
Patna High Court CR. MISC. No.57425 of 2025(3) dt.11-11-2025 2/2 petitioner. Petitioner claims clean antecedent. 5 . Learned counsel for the State opposed the bail petition.
6. Considering the statement of the victim recorded under Section 183 of the B.N.S.S. and other circumstances of the case, in the event of arrest or surrender within eight weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, I/C, Kishanganj in connection with Kochdhaman P.S. Case No. 257 of 2024, subject to the conditions laid down under section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
