The petitioner apprehends his arrest in connection with Sikarpur P.S. Case No. 329 of 2015 for the offences punishable under Section 7 of the Essential Commodities Act. The allegation against the petitioner is of irregularities in the stocking of food grains inasmuch as according to the prosecution one bag of wheat and 21 bag of rice were found missing.
Learned senior counsel appearing on behalf of the petitioner has submitted that apart from the fact that the inspection was made at 7:00 P.M. which is not the correct time to carry out any inspection even otherwise the allegation is not in tune with the factual position which can be physically verified.

No.52975 of 2015 (2) dt.16-12-2015 Having heard learned counsel for the parties and considering the submissions of learned counsel as also the nature of allegation, let the petitioner, namely, Satyendra Dubey @ Satyendra Dhar Dubey in the event of his arrest or surrender within four weeks from today be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, West Champaran, Bettiah and/or the court concerned in connection with Sikarpur P.S. Case No. 329 of 2015 subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
