1. Heard learned counsel for the petitioner and learned APP for the State.

2. The petitioner seeks bail in anticipation of his arrest in a case registered for the offences punishable under Sections 147, 149, 341, 323, 307, 379, 504 and 506 of the Indian Penal Code and Section 27 of the Arms Act.

3. The learned counsel for the petitioner submits that the petitioner has antecedent of two cases and the informant alleges that accused persons including the petitioner came on the land of the informant variously armed and assaulted him and even fired. Further, Devendra and Harendra snatched his gold chain.

4. The learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case by the

No.58706 of 2024(2) dt.28-08-2024 2/2 informant It is next submitted that the injury suffered by the injured is simple in nature and there is no specific allegation of assault against the petitioner and Title Suit No.457 of 2021 is pending adjudication in between the parties in the Court of the learned Subordinate Judge-VI, Bhojpur.

5. Learned A.P.P. Sri Rabindra Kumar opposes the anticipatory bail application.

6. Considering the submissions made by the learned counsel for the petitioner, the petitioner, above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhojpur at Ara in connection with Udwantnagar P. S. Case No.499 of 2023, subject to the conditions laid down under Section 438(2) of the Cr.P.C.

7. The application stands allowed.
