The petitioners apprehend their arrest in connection with Excise Complaint Case No.24C2 of 2019 registered under Section 30(a) of the Bihar Prohibition and Excise Act, 2016. The accusation is of recovery of 12 bottles, each containing 750 ml. Indian Made Foreign Liquor, 24 bottles, each containing 375 ml. Indian Made Foreign Liquor and 48 bottles, each containing 180 ml. Indian Made Foreign Liquor, from a bush, situated behind the house of Madho Singh, the father of the petitioners.

Learned counsel for the petitioners submits that the

Patna High Court CR. MISC. No.51999 of 2019(2) dt.21-08-2019 2/2 alleged recovery of Indian Made Foreign Liquor was made from a bush, situated behind the house of Madho Singh, the father of the petitioners, and not from the house of the petitioners. Having considered the facts and the circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender by them within six weeks from today, be enlarged on bail on their furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-II, Begusarai-cum-Special Judge, Bihar Prohibition and Excise Act, 2016, Begusarai, in connection with Excise Complaint Case No.24C2 of 2019, subject to the conditions laid down under Section 438(2) Cr.P.C.
