2. In this case, the petitioner is seeking regular bail in connection with Rail/Kiul P.S. Case No. 97 of 2024, registered for the offences punishable under Sections 379, 356/414 of the Indian Penal Code.

3. As per allegation, co-accused Chhotu Kumar Paswan stole a ladies purse at Kiul Railway Station, in which two mobile phones were kept and given the stolen mobile to the petitioner. Thereafter, the police apprehended the petitioner with a silver colour vivo mobile.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated.

Patna High Court CR. MISC. No.58294 of 2024(2) dt.21-08-2024 2/2 He is a person of clean antecedents. He is under custody since 14.06.2024. Learned counsel further submits that there is nothing against the petitioner except the confessional statement of co-accused.

Considering the above-mentioned facts and circumstances especially the clean antecedents, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Rail Judicial Magistrate, Kiul in connection with Rail/Kiul P.S. Case No. 97 of 2024, subject to the following conditions:- (i) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.

(ii) If the petitioner is found involved in future in the similar type of offence, the prosecution will have liberty to file an application before the court below for cancellation of the bail of the petitioner and the learned court below will take decision in accordance with law.
