JUSTICE VINOD KUMAR SINHA ORAL ORDER 01-03-2017 The petitioner is in custody since 19.09.2017 in connection with Kesariya P.S. Case No. 247 of 2016, registered for offences punishable under Sections 406 and 420 of the Indian Penal Code.
It has been submitted on behalf of the petitioner that as alleged he is no where concern with the Sahara India, rather he is an agent of Kolkata Ware Industry Ltd, however the transaction of the said company was stopped by Securities and Exchange Board of India (SEBI) as such the amount invested by informant and others could not be refunded.
Heard learned A.P.P. also.
Having heard both sides, in view of the fact that there is direct allegation against the petitioner, I am not inclined to grant
Patna High Court Cr.Misc. No.7087 of 2017 (3) dt.01-03-2017 2/2 the petitioners the privilege of regular bail, at this stage, it is accordingly rejected.
However, the petitioner may renew his prayer for bail after framing of charge in this case before the court below itself, which will be considered by the court below on the merit of the case, without being prejudiced by the order of this Court. (Vinod Kumar Sinha, J) sunil/- U T
