JUSTICE DINESH KUMAR SINGH ORAL ORDER 24-11-2015 Learned counsel for the petitioner is permitted to make necessary correction in the petition, as prayed for. Heard learned counsels for the petitioner and the State. The petitioner being widow mother of the husband of the victim is apprehending arrest in a case registered for the offences punishable under Sections 304B/34 of the Indian Penal Code.

The accusation is of killing the sister of the informant after five years of marriage for non fulfillment of dowry demands. The informant came to know from the neighbours that co accused Hera Yadav, Mritranjan Yada and Chhotelal Yadav assaulted his

Patna High Court Cr.Misc. No.53542 of 2015 (2) dt.24-11-2015 2/2 sister and killed her by pressing her neck. The postmortem report reflects presence of ligature mark on the neck of the victim. It is submitted by the learned counsel for the petitioner that the accusation is not specific against the petitioner and the victim committed suicide. It is further submitted that subsequently the informant retracted from the initial version and has filed a petition to that effect before the learned court below. Considering the accusation being omnibus and general and the petitioner being widow, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned JM Ist Class, Gopalganj in connection with Manjhagarh P.S. Case No.142 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
