JUSTICE BIRENDRA KUMAR ORAL ORDER 21-03-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offences punishable under Sections 379/411 of the Indian Penal Code.

Allegation is that the petitioner committed theft of paddy bags.

Submission of the petitioner is that due to dispute relating to payment of carriage the false case has been lodged. Petitioner has got no criminal antecedent.

Considering the facts aforesaid, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount

Patna High Court Cr.Misc. No.12891 of 2017 (2) dt.21-03-2017 2/2 each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur at Ara/Successor Court, in connection with Agiaon (Garahani) P.S. Case No.6 of 2017, with condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.
