JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-12-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

This is an application for grant of anticipatory bail for the offences punishable under Section 304(B)/34 of the Indian Penal Code.

It has been submitted on behalf of the petitioner that the petitioner is cousin sister of the husband of the deceased and nothing specific has been attributed against the petitioner and there is omnibus allegation.

Having heard both sides and in view of the fact that the petitioner is cousin sister of the husband of the deceased and no specific overt act has been alleged against the petitioner, let the petitioner, above named, in the event of her arrest or surrender

Patna High Court Cr.Misc. No.49273 of 2016 (3) dt.20-12-2016 before the Court below within a period of six weeks from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate 6, Samastipur in connection with Sarairanjan P.S. Case No. 163 of 2015 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure also with condition that the petitioner shall co-operate with the investigation as well as in the trial.
