JUSTICE VINOD KUMAR SINHA ORAL ORDER 04-11-2019 This is an application for grant of anticipatory bail in connection with G.O. Case No. 493 of 2019, arising out of Biraul P. S. Case No. 120 of 2019, disclosing offences under Sections 272, 273, 34 of IPC and Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

As per F.I.R. police on information raided the plot of one of the co-accused. There is recovery of huge quantity of liquor from there and two person were arrested and petitioner was named by the co-accused persons, as the persons who are engaged for the same business.

Submission of the learned counsel for the petitioner is that except confessional statement, there is nothing against the petitioner. He has no criminal antecedent.

Heard learned A.P.P. also, who on perusal of the case diary also could not bring any fact except that petitioner is

Patna High Court CR. MISC. No.51813 of 2019(3) dt.04-11-2019 2/2 named in the F.I.R. on the basis of confessional statement of the co-accused.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned 2nd Additional Sessions Judge-cum-Special Judge (Excise Act), Darbhanga, in connection with G.O. Case No. 493 of 2019, arising out of Biraul P. S. Case No. 120 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
