JUSTICE DINESH KUMAR SINGH ORAL ORDER 02-12-2015 Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 323, 307, 379, 504, 34 of the Indian Penal Code. It is alleged that petitioner No.1 came to the informant and started abusing, on protest being made, the informant was assaulted with piece of bamboo. When the sister-in-law of the informant Tila Devi came to rescue then she was assaulted with the piece of bamboo by petitioner No. 2. It is further alleged that co-accused Naz Kumari and Bipin Kumar also assaulted by fists and slaps.
It is submitted by learned counsel for the petitioners that petitioners are agnates of the informant and in the background of land dispute the accusation has been levelled when no substantial injury has been caused to the informant's side.

Considering the aforesaid facts, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur in connection with Jagdishpur(Goradih) P.S. Case No. 171 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Dinesh Kumar Singh, J) Shageer/- U T
