JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 30-05-2017 Heard learned counsel for the petitioner and the State.

The petitioner is accused in connection with Jokihat P.S. Case No. 16 of 2017 for the offence under Section 414/34 of the Indian Penal Code and Section 25(1-b)A, 26 and 35 of the Arms Act.

From the perusal of the F.I.R. it appears that country made pistol was recovered from the possession of the petitioner. The petitioner is in jail since 23.01.2017. The petitioner stated in para-3 of the petition that he has no criminal antecedent. It appears that Md. Masood, from whose possession cartridges were recovered, was granted bail by this Hon'ble Court on 19.04.2017 passed in Criminal Miscellaneous No. 15319 of 2017.

No.21030 of 2017 (2) dt.30-05-2017 2/2 Considering the statement made in para 3 of the petition and the fact that similar circumstance other co-accused was granted bail by this Court on 19.04.2017 passed in Criminal Miscellaneous No. 15319 of 2017. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Amit Kumar Manu, ACJM, Araria or his successor Court in connection with Jokihat P.S. Case No. 16 of 2017 on the condition that the petitioner shall co-operate in the trial and will not in any manner influence the evidence or the witnesses.
