Petitioner apprehends arrest in a case registered for the offences punishable under Sections 272, 273/34 of Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

As per prosecution case, 1.5 litres foreign liquor has been recovered from Passion Pro Motorcycle.

Learned Counsel for the petitioner submits that the petitioner has falsely been implicated in this case. Petitioner is neither driver nor owner of the vehicle in question. Nothing has been recovered from conscious possession of the petitioner. Petitioner has got no criminal antecedent.

Considering the aforesaid facts and circumstances, let the above named petitioner in the event of his arrest/surrender

Patna High Court CR. MISC. No.54210 of 2022(2) dt.18-11-2022 2/2 before the court below within a period of thirty days from the date of receipt/production of copy of this order, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Exclusive Special Judge, Excise, Court No. II, Muzaffarpur in Saraiya P.
