JUSTICE DINESH KUMAR SINGH ORAL ORDER 12-08-2015 The present modification application has been filed for extending the period of provisional anticipatory bail granted to the petitioner for four months vide order dated 09.10.2013 passed in Cr. Misc. No. 33068 of 2013 in a case registered for the offences punishable under Sections 379/34 of the Indian Penal Code and Section 135 of the Electricity Act. The accusation is of consumption of electric energy unauthorizedly. The loss was calculated to the tune of Rs. 2, 73, 000/- The petitioner undertook to deposit 50% of the loss calculated amount within a period of four months. Hence, bail bond was directed to be accepted provisionally till deposit of 50% of the loss calculated amount. The said order was modified vide order dated 17.12.2013 to the extent that four months time was to be calculated from the date of
Patna High Court Cr.Misc. No.19526 of 2014 (2) dt.12-08-2015 2/2 receipt/production of the copy of this order. But, it appears that till date the petitioner has not deposited the 50 % of the loss calculated amount, hence the present modification application.
It appears that for modification of the order dated 09.10.2013, the present modification application has been filed on 29.04.2014.
Considering the casual approach adopted by the petitioner, this Court is not inclined to modify the earlier order.
Let learned Court below cancel the bail bonds of the petitioner in connection with Vidyapatinagar P.S. Case No. 77 of 2012, pending in the Court of learned Additional Chief Judicial Magistrate, Dalsingsarai, Samastipur. Accordingly the modification application is disposed of.
