Petitioners apprehend their arrest in a case registered for the offence punishable under Section 308, 324 and some other minor Sections of the Indian Penal Code.

As per F.I.R. specific accusation of assault is against Mohan Chaudhary and Rajan Mahto.

Learned counsel appearing for the petitioners submits that petitioners are innocent and have falsely been implicated in the case. There is general and omnibus allegation of assault against these petitioners and no specific overt act has been attributed against them. Petitioners have got clean antecedent.

Patna High Court CR. MISC. No.64652 of 2021(2) dt.12-07-2022 2/2 Learned counsel appearing for the State and the informant opposed the prayer for anticipatory bail. Considering the facts of the case, nature of accusation and clean antecedent of the petitioners, let the petitioners, above named, in the event of his arrest/ surrender within a period of six weeks from today shall be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st class, Vaishali at Hajipur in connection with Tisiauta PS case No. 54/ 2021, subject to conditions laid down u/s 438(2) of the Cr. P. C.
