The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 447, 341, 342, 379, 384, 386, 397, 50, 506 of the Indian Penal Code, sections 33, 41, 42 of the Indian Forest Act and 4/5 of The Environment (Protection) Act, 1986. The prosecution case is that the informant made protest for cutting the Sisam and Sirish trees by the petitioners then the petitioners assaulted the informant and demanded rupees fifty thousand as extortion.

It is submitted by learned counsel for the

Patna High Court Cr.Misc. No.54010 of 2015 (2) dt.27-11-2015 2/2 petitioners that the dispute with regard to the land on which the trees were standing and after the measurement it was found that the trees were standing on the land of the petitioners. Subsequently the informant has retracted from the initial version and filed a petition to that effect before the learned court below. The same has been brought on record as Annexure-2. A statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent. Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Gaya in connection with Guraru P.S. Case No. 46 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
