The petitioner seeks bail in a case registered for the offences punishable under Sections 401, 379 and 511 of the Indian Penal Code.

Learned counsel for the petitioner submits that petitioner is in custody since 03.07.2021 and chargesheet has been submitted. Petitioner is a person with clean antecedent. Learned counsel for the petitioner submits that informant alleges that he received secret information that a gang of thieves were planning to commit theft in a shop, namely, Keeper Pipes Hardware. Accordingly, the informant reached the shop and one accused Shilok Kumar (petitioner) arrested while two accused fled away. It is further alleged that from the petitioner one cutter, mobile and three master keys were recovered.

No.64767 of 2021(2) dt.31-03-2022 2/2 Learned counsel for the petitioner submits that petitioner has been falsely implicated in this case and even presuming what has been alleged is true without adverting that merely it is a case of attempt in which the petitioner failed. Learned counsel for the petitioner further submits that the petitioner is a person with clean antecedent. Learned A.P.P. for the State vehemently opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody since 03.07.2021, chargesheet has been submitted in the case, petitioner is a person with clean antecedent and it is petitioner's first offence, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/successor Court in connection with Kankarbagh P.S. Case No. 581 of 2021 with a condition that one of the bailor shall be the mother of the petitioner Dharmshila Devi.
