2. The petitioner seeks regular bail in connection with Mirganj P.S. Case No.04 of 2023 lodged under Section 414 of the IPC read with Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

3. Learned counsel for the petitioner submits that the bail application of the petitioner has earlier been rejected vide order dated 07.02.2024 passed in Cr. Misc. No.5338 of 2024 with liberty that he may renew his prayer for bail 3 months after framing of charge.

4. Learned counsel for the petitioner further submits that the petitioner is in custody since 29.05.2023 and charge has already been framed on 04.05.2024. He further submits that

5. Learned APP for the State opposes the prayer for bail.

In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail, subject to payment of Rs.10,000/- (Ten thousand) in the Prime Minister National Relief Fund, on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) as mentioned in Section 2(1) (d) of the BNSS, 2023 to the satisfaction of Addl. District and Session Judge-IV-cumExclusive Special Excise Court -II, Gopalganj in connection with Mirganj P.S. Case No.04 of 2023, subject to the following conditions as laid down under Section 480(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
