Petitioner apprehends his arrest in connection with a case registered under Sections 147, 148, 149, 323, 337, 379, 384, 504 and 427 of the Indian Penal Code.

Allegation is that this petitioner along with other coaccused, after forming an unlawful assembly entered into the house of the informant, assaulted the husband of the informant, committed theft and also demanded extortion. The specific allegation is that Gunjan Kamat gave iron rod blow to Shambhu Kamat, the husband of the informant who became unconscious. Submission is that there is no specific allegation of assault against the petitioner to anyone and Gunjan Kamat and others, against whom there is specific allegation of assault, have

Considering the post-mortem report of the deceased that the cause of death was Cardio respiratory failure due to hyper tension from which the deceased was suffering, so in the event of arrest/surrender within four weeks from the date of receipt of this order to the concerned court, let the petitioner, namely, Dinesh Kamat be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Supaul in connection with Supaul P.S.
