JUSTICE DINESH KUMAR SINGH ORAL ORDER 08-12-2015 Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 420, 467, 468, 471, 34 of the Indian Penal Code.
The prosecution case is that co-accused Dhrup Shankar Sah and Rajesh Sah applied for KCC loan on the basis of forged rent receipt. The name of the petitioners transpired during investigation as the persons who were present when the loan applications were submitted. It is submitted by learned counsel for the petitioners that petitioners were not named in the First Information Report and they have been roped in the present case only on suspicion.
A statement has been made in para 3 of the petition that petitioners have no criminal antecedent.

No.55505 of 2015 (2) dt.08-12-2015 2/2 Considering the thrust of accusation against other co-accused and petitioners having no criminal antecedent, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Raxaul at Motihari, East Champaran in connection with Palanwa P.S. Case No. 7 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
