1. Heard learned counsel for the parties.

2. The petitioner has preferred this application for grant of regular bail in connection with Korha P.S. Case no.180 of 2023 registered under section 395 of the Indian Penal Code in which section 412 of the Indian Penal Code and sections 25(1-B)(a), 26 and 35 of the Arms Act were added subsequently.

3. As per the prosecution case, six accused persons on motorcycle are said to have looted and dispossessed the informant of the tractor loaded with maize crops.

4. Learned counsel for the petitioner submits that the F.I.R was registered against unknown. The name of the petitioner transpired in course of investigation in the confessional statement of co-accused Navin Kumar. The said Navin Kumar only states that he sold some of the stolen articles

Patna High Court CR. MISC. No.57214 of 2023(4) dt.08-11-2023 2/2 to this petitioner. Further Navin Kumar has himself been enlarged on bail vide order dated 11.8.2023 passed in Cr. Misc. no.50824 of 2023. The petitioner is in custody since 10.5.2023 and has no criminal antecedent.

Having heard learned counsel for the parties and taking into consideration the nature of material that has transpired in course of investigation, grant of bail to co-accused Navin Kumar by the above mentioned order on whose confessional statement the name of the petitioner transpired, the petitioner being in custody since 10.5.2023 and charge-sheet having been submitted in the case, the petitioner is directed to be enlarged on bail in connection with Korha P.S. Case no.180 of 2023 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Katihar.
