The petitioner is languishing in custody since 21.04.2015 in connection with Sessions Trial No. 33 of 2016, arising out of Sasaram (Dehri) G.R.P. P.S. Case No. 01 of 2015 for the offences instituted under Sections 302 of the IPC and 27 of the Arms Act. The prosecution case, in short, is that on 01.01.2015 at 7.00 P.M. when the informant's father did not return home, the informant went out to trace him. At last, he traced his father near the Car Stand in an injured condition. Thereafter, the informant's father was taken to hospital for medical treatment, where he died. Earlier the bail application of the petitioner was rejected

Patna High Court Cr.Misc. No.6356 of 2017 (3) dt.15-03-2017 2/2 vide Cr. Misc. No. 32827 of 2015 with a direction to the court below to conclude the trial preferably within a period of one year from the date of receipt/production of copy of the order. In light of the said direction, this is second attempt on behalf of the petitioner for grant of bail.

A report was called for from the court below regarding the stage of the case. It has been reported that the statement of the accused under Section 313 Cr. P.C. has been recorded and the trial is expected to be concluded within a period of two months. Considering the aforesaid facts and circumstances, I am not inclined to grant bail to the petitioner at this stage. The same is rejected in Sessions Trial No. 33 of 2016, arising out of Sasaram (Dehri) G.R.P. P. S. Case No. 01 of 2015, pending in the court of the learned Additional Sessions Judge-IV, Sasaram. The court below is directed to take all necessary steps to conclude the trial within the stipulated period as indicated in the report.
