JUSTICE ARUN KUMAR ORAL ORDER 17-03-2017 Heard learned counsel for the petitioner and learned APP appearing on behalf of the State.

Petitioner, already in custody, seeks bail in connection with Aurangabad (Muffasil) P.S. Case No.100 of 2016, registered under Sections 399, 402, 414 and 420 of the Indian Penal Code as well as Sections 25(1-b)a/26/35 of the Arms Act. Allegation in brief is that police apprehended some miscreants assembled at a place for committing robbery and they disclosed the names of this petitioner and few others who fled away.

Learned counsel for the petitioner submits that there is no material against the petitioner except the disclosure of his name by apprehended accused persons and this petitioner has got only one criminal antecedent and in that case the petitioner was

Patna High Court Cr.Misc. No.11466 of 2017 (2) dt.17-03-2017 2 / 2 implicated after lodging of this case. The police has submitted charge-sheet in this case and this petitioner has been in custody since 27.07.2016.

Having considered the said facts and circumstances, petitioner Pintu Kumar is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad in connection with Aurangabad (Muffasil) P.S.
