JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 02-12-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Forest Case No. 21 of 2012 registered under Sections-33, 41 & 42 of the Forest Act.
Petitioner No. 1 is owner and petitioner No. 2 is driver of the seized truck, on which illegal stone chips were found loaded and the prosecution claims that petitioners did not have any valid paper in respect of the loaded chips.
Although learned counsel, appearing for petitioners tried to convince me about the innocence and false implication of the petitioners but I am not, at all convinced with the submissions
Patna High Court Cr.Misc. No.44566 of 2016 (2) dt.02-12-2016 2/2 advanced by learned counsel for the petitioners. Accordingly, this anticipatory bail petition stands rejected.
However, this order shall not cause any prejudice to the concerned court at the time of consideration of regular bail application of the petitioners.
