JUSTICE SANJAY PRIYA ORAL ORDER 09-05-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Siwan Nagar P.S. Case 332 of 2016 instituted for the offence under Sections 401, 413, 414/34 of the Indian Penal Code, Sections 20 and 22 of the N.D.P.S. Act.
It has been submitted that petitioner was not arrested on the spot. His name has been disclosed by accused namely, Amish Kumar Singh @ Vikky and Vivek Dubey who were apprehended on the spot and they have been granted bail by a coordinate Bench of this Court vide order dated 25.1.2017 passed in Cr. Misc. 40732 of 2016 and 44628 of 2016. From the written report it appears that co-accused riding on another motorcycle fled away after leaving his
Patna High Court Cr.Misc. No.11939 of 2017 (4) dt.09-05-2017 2/2 motorcycle. It is mentioned in the written report that nothing incriminating article has been recovered from the said motorcycle. From the seizure list it appears that there is no recovery from the possession of the petitioner. Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-I-cum-Special Judge, N.D.P.S., Siwan, in connection with NDPS Tr. No. 75 of 2016 arising out of Siwan Nagar P.S. Case No. 332 of 2016, subject to the condition that both the bailors will be the close relatives of the petitioner.
