The petitioner is apprehending his arrest in connection with K.Hat (Sahayak) P.S.Cas no.190 of 2019 registered for offences punishable under Sections 419, 420, 379 of the Indian Penal Code.

Prosecution story is that the informant had gone to withdraw Rs.20,000/- in the meantime, one person standing behind him changed his ATM Card and later on he came to know that Rs.16,500/- and Rs.23,500/- has been withdrawn from his account and when he bring out the statement of his account, it appears that Rs.16,500/- has been transferred to the account of co-accused Jitendra Paswan and Rs.23,500/- has been transferred to the account of this petitioner. Submission of the learned counsel for the petitioner is

Patna High Court CR. MISC. No.52111 of 2019(2) dt.21-08-2019 2/2 that she is aged about 63 years and she is also a widow lady . She has no knowledge about the aforesaid transfer. She is still ready to return the aforesaid amount.

Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, this application is disposed of with direction to the petitioner that she will deposit the aforesaid amount of Rs.23,500/- in the account of the informant by 4.9.2019 and thereafter she will surrender before the learned court below along with the receipt of the deposit and considering the same the learned court below shall release the petitioner in connection with K. Hat (Sahayak) P.S.Caase No.190 of 2019, to his own satisfaction.

With the aforesaid direction, this application is disposed of.
