The petitioners apprehend their arrest in Pothia P.S. case No. 46 of 2019 registered under Section 341, 323, 379, 504, 506/34 of the IPC.

The informant alleged that when he went to his land the petitioners and others caught him and assaulted him with fists and slaps and also took his motor cycle. The learned counsel for the petitioners submits that Pothia P.S. case No. 47 of 2019 is registered on the basis of fard bayan of petitioner No.2 in which petitioner No.2 made allegation against the informant, Jai Prakash, that he was intercepted by Jai Prakash and others and they assaulted him.

Considering the facts aforesaid and nature of allegation made against the petitioners, the petitioners, above named, in the event of their arrest/ surrender before the court below within a period of four weeks from the date of receipt/ production of a copy of this order are directed to be enlarged on bail on their furnishing bail bond of Rs. 10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kishanganj in connection with Pothia P.S. case No. 46 of 2019, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
