JUSTICE VINOD KUMAR SINHA ORAL ORDER 12-05-2017 The petitioner seeks regular bail in connection with Ghorasahan P.S. Case No. 09 of 2017, registered for offences punishable under section 20(B)/22/23/24 of NDPS Act. Allegation against the petitioner is of recovery of one kg. Ganja from his possession.
It has been submitted that he has falsely been implicated in this case and he has clean antecedent and has remained in custody for about four months.

In the facts and circumstances as stated above, let the petitioner named above be released on bail on furnishing bail bond of Rs. 25,000/- (Twenty five thousand) with two sureties of the
Patna High Court Cr.Misc. No.21617 of 2017 (3) dt.12-05-2017 2/2 like amount each to the satisfaction of learned Sessions Judge/Special Judge, East Champaran, Motihari in NDPS Case No. 04/2017, subject to the following conditions:- (i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned court.
(ii) The petitioner will not induce any witness or tamper with the evidence.
(iii) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court and on the even of failure on his part to appear before the court below on two consecutive dates without obtaining prior permission from the court concerned, the prosecution is free to move for cancellation of his bail.
