JUSTICE ASHUTOSH KUMAR ORAL ORDER 25-04-2018 The petitioner seeks bail in anticipation of his arrest in connection with Madhepura (Bharrahi) P.S. Case No. 755 of 2017 dated 28.10.2017 instituted for the offences under Sections 341, 323, 324, 307, 34 of the Indian Penal Code. The petitioner along with eight others is alleged to have entered the house of the informant and assaulted his brother-in-law and the husband. So far as the petitioner is concerned, the allegation is only of being part of the mob of nine persons. One Md. Shahabuddin, a co-accused is alleged to have assaulted the brother-in-law and husband of the informant on the orders of co-accused Md. Juber. The injuries suffered by the husband of the informant are primarily simple in nature but for one of the injuries on his person which has

The petitioner is not the author of any of the injuries either on the person of brother-in-law or the husband of the informant. The petitioner does not have any criminal antecedent and he is one of the agnates of the informant. Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before learned Court below within a period of four weeks from today, be released on bail on his furnishing bail bonds of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhepura in connection with Madhepura (Bharrahi) P.S. Case No. 755 of 2017.
