JUSTICE RAKESH KUMAR ORAL ORDER 22-11-2016 After some argument, Sri Bashisth Narain Mishra, learned counsel, assisted by Sri Brij Kishore Mishra, learned counsel for the petitioners, in presence of learned Additional Public Prosecutor as well as Sri Uma Shankar Singh , learned counsel for the complainant/ opposite party no. 2 makes a prayer for disposal of the present petition so that petitioners may take the plea which has been taken in the present petition before the court below at appropriate stage.
The prayer is allowed.
The petition stands disposed of with observation that if
Patna High Court Cr.Misc. No.23688 of 2013 (5) dt.22-11-2016 2/2 at appropriate stage such petition is filed before the court below, the learned court below without being prejudiced with this order may examine the same and pass appropriate order in accordance with law.
It is made clear that this court has not recorded any opinion on the merit of the case.
