The petitioner is apprehending arrest in a case registered for the offences punishable under sections 376,341,342,323,506 and 509 of the Indian Penal Code. The prosecution case is that the informant was sexually exploited by the petitioner for three years on promise of marriage.

It is submitted by the learned counsel for the petitioner that even assuming the accusation no offence under section 376 IPC is made out. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.

No.56030 of 2015 (2) dt.16-12-2015 2/2 The aforesaid facts constitute ground for consideration of the prayer for regular bail of the petitioner by the learned court below in case the petitioner surrenders within six weeks from today in connection with Kishanganj Mahila P.S. Case No. 52 of 2015 pending in the court of learned SDJM, Kishanganj. This application is disposed of with the aforesaid observation/direction.
