This is a petition for grant of anticipatory bail for offence under Sections 272 and 273 of the Indian Penal Code and 47(a) of the Excise Act.

From the house of the petitioner twenty liters of country made liquor was allegedly recovered.

Submission of the petitioner is that at the time alleged recovery, no family members of the petitioner was there, therefore, the recovery itself is doubtful. The petitioner has got no criminal antecedent.

Considering the aforesaid fact, the petitioner, above named, in the event of his arrest or surrender, within four weeks from the date of receipt of this order, be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with K. Hat (Madhubani) P.S. Case No. 45 of 2016 to the satisfaction of the Chief Judicial Magistrate, Purnea, or successor Court, subject to the condition laid down under Section 438(2) of the Criminal Procedure Code.
