2. This writ petition has been filed for issuance of direction to the respondents to lodge FIR in the matter of this petitioner for fair investigation in the case because the SHO of Kalpa Police Station, Jehanabad is allegedly not lodging the FIR even after the direction of respondent nos. 3 and 4.

3. After some argument, learned counsel for the petitioner prays for and is permitted to withdraw this application with liberty to file a complaint case in the District Court having

Patna High Court CR. WJC No.1461 of 2023(4) dt.04-08-2025 2/2 jurisdiction over the matter.

4. Accordingly, this application is dismissed as withdrawn with the aforesaid liberty to the petitioner.

5. If any such complaint case is filed by the petitioner, then the same shall be considered and decided by the Magistrate in accordance with law.

6. This Court has not expressed any opinion on the merits of the case.
