The petitioner seeks bail in a case instituted for the offences under Section 392 of the Indian Penal Code. Prosecution allegation, in short, is that the motorcycle of the informant was snatched by the accused person. It has been submitted on behalf of the petitioner that the petitioner is in custody since 25.2.2019. Chargesheet/prosecution report has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The present case is misuse of privilege of bail. The petitioner was granted anticipatory bail on 29.5.2006 by the Coordinate Bench of this Court but the proper pairvi was not
Patna High Court CR. MISC. No.54333 of 2019(3) dt.05-09-2019 2/2 made in the Court below. The petitioner undertakes that he would cooperate during the trial. He has remained in custody for about six months.
On behalf of the State, it is submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, it is directed that the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea in connection with Kasba P.S.
