Petitioner is accused in connection with Akbarpur P.S. Case No. 13 of 2015 registered under Sections 302 and other allied sections of the I.P.C.
Learned counsel for the petitioner submits that the allegations levelled are general and omnibus. There is delay of three days in lodging the first information report however there is no explanation. Co-accused persons have been granted bail by this Court. Petitioner has no criminal antecedent and is in custody since 16.12.2016.
Learned Addl. P.P. appearing for the State opposes the prayer for bail and submits that petitioner is named in the first
Patna High Court Cr.Misc. No.16253 of 2017 (2) dt.26-04-2017 2/2 information report and there is direct allegation of assault against the petitioner.
Having considered the facts and circumstances of the case, the nature of allegations levelled and the submissions advanced on behalf of the parties, I do not feel inclined to grant the privilege of bail to the petitioner. His prayer for bail is, therefore, rejected.
