In this application for anticipatory bail the petitioners apprehend their arrest in connection with Kawakole P.S. Case No. 111 of 2016 for the offence punishable under section 366 (A)/34 of the I.P.C.
Allegedly, the minor daughter of the informant become traceless when she had gone to attend coaching and when the informant went at the house of the petitioners to search her, the petitioners abused and became adamant to assault, during investigation the victim girl has appeared and her statement has been recorded under section 164 of the Cr.P.C where she had
Patna High Court Cr.Misc. No.51473 of 2016 (2) dt.19-12-2016 2/2 denied the allegation of kidnapping and stated that she went out of her own will and she is living with her uncle and her father lodged this case due to ignorance.
In the facts and circumstances as stated above, considering that the victim girl has not supported the allegation of kidnapping and as such the petitioners, in the event of their arrest or surrender within six weeks from the date of receipt/production of a copy of this order, shall be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of.
