JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 05-06-2017 Heard learned counsel for the petitioner and the State. The petitioner is accused in Bihra P.S. Case No. 108 of 2016 for the offences punishable under Sections 147, 148, 149, 341, 323, 324, 307, 448, 379, 427, 504, 506 of the Indian Penal Code and Section 302 IPC was subsequently added. The petitioner is in custody since 15th February, 2017.
From perusal of the petition it appears that there is case and counter case. From the FIR it appears that no specific allegation of any overt act has been alleged against the petitioner. The similarly circumstanced other co-accused against whom there is allegation of even assault have been released on bail by this Court.
In view of the facts and circumstance mentioned
Patna High Court Cr.Misc. No.22426 of 2017 (2) dt.05-06-2017 2/2 above, particularly the fact that other co-accused namely, Tarjan Singh @ Sumit Kumar Singh in Cr. Misc. No. 16909/2017 vide order dated 11.4.2017, Ripu Singh in Cr. Misc. No. 17236/2017 vide order dated 17.4.2017, Mithilesh Singh @ Mithalesh Singh in Cr. Misc. No. 11920 of 2017 vide order dated 27.3.2017, Anand Kishor Singh @ Anand Singh @ Munna Singh in Cr. Misc. No. 14943 of 2017 vide order dated 9.5.2017, Mantun Singh and Sanjeev Singh in Cr. Misc. No. 7824 of 2017 vide order dated 18.3.2017 have been granted bail, I am inclined to release the petitioner, above named, on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Saharsa in connection with Bihra P.S. Case No. 108 of 2016, subject to the condition that the petitioner will extend full co-operation in conclusion of the trial and will not, in any manner, influence the witnesses.
