2. The petitioner apprehends his arrest in a case registered for the offence under Sections 8(b), 18, 29 of the N.D.P.S. Act.
3. As per the prosecution case, petitioner is alleged to be involved in illegal cultivation of opium plants on large scale over the forest land.
4. Learned counsel for the petitioner submits that petitioner has been falsely implicated in this case. He further submits that neither the petitioner was involved in illegal cultivation of opium plants nor was present at the time of alleged occurrence. Similarly situated co-accused Birendra Manjhi has already been granted anticipatory bail by this Court, vide order dated 05.08.2024 passed in Cr.Misc. No. 40706 of 2024. Petitioner claims clean antecedent.

5. Learned A.P.P. for the State has opposed the prayer for anticipatory bail.
6. Considering the aforesaid facts and circumstances, in the event of arrest/surrender before the Court below within a period of eight weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge-cum-Special Judge, NDPS Act, Gaya in connection with Barachatti P.S. Case No. 79 of 2024, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
