JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 23-09-2016 Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State. This application, for grant of anticipatory bail, arises out of Beldaur Police Station Case No. 177 of 2015, disclosing offences under Sections 364/302/201/34 of the Indian Penal Code and Section 27 of the Arms Act, 1959. The petitioner has annexed part of the case diary, relating to First Information Report of Beldaur Police Station Case No. 177 of 2015, by way of Annexure-2 to this application.
This is clear indication that the petitioner has procured the copy of the case diary illegally and, thus, he is attempting to influence the course of investigation. Considering the above, I am not inclined to
Patna High Court Cr.Misc. No.40833 of 2016 (2) dt.23-09-2016 2/2 grant the petitioner privilege of anticipatory bail. This application for anticipatory bail, is hereby, rejected.
The petitioner, Prabhat Kumar Singh, is directed to surrender before the Court below within a period of four weeks from today and seek regular bail, if so advised. If he does so, his application for regular bail shall be considered by the learned Court below on its own merit without being prejudiced by rejection of present application for grant of anticipatory bail.
