This application, for grant of anticipatory bail, arises out of Jaida P.S. Case No. 18 of 2016, disclosing offences under Sections 392 and 411 of the Indian Penal Code. It is alleged in the First Information Report that the miscreants snatched informant's motor-cycle at the point of fire arm. After the police having been informed, one of the miscreants on chase was apprehended, who disclosed his identity as Bitu Kumar @ Suman Sauarabh. In course of investigation, he disclosed the petitioner's name as his accomplice.

Learned counsel, appearing on behalf of the

Patna High Court Cr.Misc. No.40651 of 2016 (2) dt.22-09-2016 2/2 petitioner, has submitted that over and above statement of said co-accused, namely, Bitu Kumar @ Suman Sauarabh, before the police, there is no material against the petitioner. He has also submitted that the petitioner has no criminal antecedent. Considering the nature of offence and the material against the petitioner, I am not inclined to grant him the privilege of anticipatory bail.

Accordingly, this application stands rejected. The petitioner, abovenamed, is directed to surrender before the court below within a period of four weeks from today and seek regular bail, if so advised. If he does so, his application for regular bail shall be considered by the learned court below on its own merit without being prejudiced by rejection of present application for grant of anticipatory bail.
