The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 363 and 366A of the Indian Penal Code.
Accusation is of kidnapping the minor daughter of the informant.
Learned counsel for the petitioners submits that in 164 Cr.P.C. statement the victim has got her age recorded as 18 years when the court below also assessed as such, though as per the medical report she was found between 18-19 years. In 164 Cr.P.C. statement the victim has further stated that she was not kidnapped rather she of her own went in her maternal aunt's
Patna High Court Cr.Misc. No.53897 of 2015 (2) dt.27-11-2015 2/2 house since she was scolded by the parents as she failed in the examination. The victim has not named the petitioners. Considering the 164 Cr.P.C. statement of the victim, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned CJM, Nawada in connection with Rajauli P.S. Case No.139 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Ashwini/- U T
