The petitioner apprehends arrest in Patory P.S. Case No. 341 of 2017 instituted for the offence under Sections 341,323,504,506,354,406,420,467,468,120B of the IPC. It is alleged in the written report that this petitioner in collusion with other accused persons has misappropriated the loan amount of Rs. 95,500/-, which was sanctioned in the name of the complainant for purchasing cattle. In complaint, it is alleged that the petitioner took the signature of the complainant on several blank papers and misappropriated the loan amount. The complainant went to inquire in the Bank then she learnt that money has already been withdrawn from her account. Case diary has been received.
Patna High Court Cr.Misc. No.11290 of 2018(3) dt.30-03-2018 2/2 After looking into the case diary, learned APP has submitted that there is material against this petitioner in the case diary that he has withdrawn the loan amount of complainant and misappropriated the same.
Keeping in view, that there is direct allegation against the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner.
Accordingly, this anticipatory bail petition stands rejected.
The petitioner is directed to surrender in the court below within six weeks from today and seek regular bail which will be considered by the court below in accordance with law and disposed off, without being prejudiced by this order. (Sanjay Priya, J) khushbu/- U T
