The petitioner seeks pre-arrest bail in connection with Majhi P.S. Case No. 126 of 2015 registered under Sections 341, 323, 307 of the Indian Penal Code and 27 of the Arms Act. It has been contended by learned Senior Counsel for the petitioner that no such occurrence as alleged in the FIR ever took place and the petitioner has been implicated in the case on account of land dispute existing from before. It has further been contended that admittedly the informant did not receive any injury from firing by a gun from close range and no empty
Patna High Court Cr.Misc. No.54013 of 2015 (2) dt.08-12-2015 2 / 2 cartridges have been recovered from the place of occurrence. Regard being had to the facts and circumstances of the case, in the event of arrest or surrender in the court below within six weeks from today, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saran at Chapra in connection with Majhi P.S. Case No. 126 of 2015 subject to the conditions as laid down under Section 438(2) Cr. P.C.
